Offer terms for direct lots

These terms apply to every offer you place on a direct lot. You accept them when you place your first offer on a lot, and the version you accepted is recorded against your offer. If the wording changes, you are asked again on your next offer.

  1. Your offer is a binding offer to buy the whole lot on the terms shown on the lot page. It cannot be withdrawn while the lot is open; you may only raise it.
  2. Offers are priced as stated on the lot (per case, per pallet or for the whole lot) and are exclusive of VAT unless the lot says otherwise. VAT is charged at the rate that applies to the goods.
  3. ClearanceFood acts as agent for the supplier. If your offer is accepted we introduce you to the supplier, who sells and invoices you directly. You pay the supplier by bank transfer within 2 UK working days of the invoice.
  4. Collection or delivery is as stated on the lot. Where the lot is collection-only, you collect within 5 working days of payment unless otherwise agreed.
  5. If the reserve is not met, the supplier may offer the lot to the leading bidder at their leading total within 72 hours of the close. You are free to accept or decline that offer.
  6. The supplier is not obliged to accept the highest offer. Where the reserve is met, an offer may be chosen on other conditions, for example collection readiness, delivery needs or payment record. Below the reserve only the leading offer can be put to the supplier.
  7. You will observe any resale conditions shown on the lot (for example "no online resale", "UK only", "no export"). A breach may exclude you from future lots.
  8. Stock is sold as described, with best-before dates as stated. Report any discrepancy to us within 24 hours of collection or delivery.
  9. Failing to pay for or collect an accepted lot is recorded and may exclude you from future lots.
